DOJ Wants Changpeng Zhao Sentenced for 3 Years

U.S. Federal Prosecutors Want Changpeng Zhao Sentenced to 3 Years (Double the Guideline)

The founder of Binance, Changpeng Zhao (CZ) is scheduled to be sentenced on April 30 for pleading guilty to a raft of violations under the Bank Secrecy Act.  Per the federal guidelines, it was expected that CZ was facing up to 18 months of prison time (or more).  Yesterday April 24, 2024 prosecutors filed a memo recommending that CZ be sentenced to 3 years in jail and pay a $50 million fine.

  • Federal prosecutors are advocating for double the 'high end' of the sentencing guidelines suggesting that it’s essential to not only hold him accountable for the wide range of charges including non-compliance of anti-money laundering laws but also to deter global crypto leaders and send the message that there will be severe consequences for abusing U.S. financial regulations for personal and corporate gain.
  • Zhao has garnered substantial support through over 160 letters from various stakeholders, including industry leaders and academics, calling for leniency in his sentencing. These letters emphasize his prior contributions to the tech and financial sectors and his philanthropic endeavors.

Worldcoin Unveils Layer-2 Blockchain 'World Chain' Focused on Human-Centric Verification

The latest update on Sam Altman's Worldcoin is that the Worldcoin Foundation has announced the launch of World Chain, a permissionless, open-source Ethereum layer 2 blockchain expected to debut in mid-2024. This new blockchain is deeply integrated with the Worldcoin protocol and aims to accelerate the adoption of "World ID."

Background

Worldcoin's system uses an "Orb" device to scan users' eyes and convert the biometric image into a secure number string. This process verifies an individual as a unique human and grants a World ID, which functions similarly to a digital passport, allowing users to authenticate various applications while confirming their personhood.

To date, 10 million people across 167 countries have registered their biometrics with Worldcoin, with their verified wallets conducting 75 million transactions. The technology is primarily aimed at distinguishing real human users from bots and AI, which are prevalent in other blockchain systems and often lead to network congestion and high transaction fees.

Despite this growth, the market response has been mixed. Since late March 2024, the market cap of Worldcoin tokens (WLD) has declined by over a third, and the price has halved. World Chain Launches

On March 26, 2024 the U.S. Department of Justice (DOJ) laid charges against Seychelles-based crypto exchange, KuCoin, and its founders Chun Gan and Ke Tang for anti-money laundering (AML) violations and operating an unlicensed money-transmitting business. These charges were based on allegations that KuCoin, despite operating with over 30 million customers worldwide, failed to implement adequate AML and Know Your Customer (KYC) procedures per the Bank Secrecy Act's AML requirements, effectively allowing the platform to be potentially used for illicit activities​.  The lack of compliance has reportedly facilitated over $9 billion in suspicious transactions, highlighting the potential for crypto exchanges to be exploited for money laundering.

The CFTC's charges centered on KuCoin's operations of an illegal digital asset derivatives exchange and committing multiple violations of the Commodity Exchange Act (CEA) and CFTC regulations​.  By classifying certain digital assets as commodities, the CFTC asserts its jurisdiction over derivatives trading related to those assets. 

Jurisdictional Dispute Between CFTC and SEC

An interesting twist in the narrative is the contention surrounding the regulatory jurisdiction over cryptocurrencies, particularly Ethereum (ETH), which has been classified by the CFTC as a commodity in its complaint against KuCoin. This classification directly contrasts with the Securities and Exchange Commission (SEC) Chair Gary Gensler’s viewpoint that most cryptocurrencies, excluding Bitcoin, could be considered securities and thus fall under the SEC’s regulatory umbrella. This divergence in regulatory approach has led to confusion and calls for clearer guidelines within the U.S. regulatory framework for cryptocurrencies.

Adding to the regulatory debate, CFTC Commissioner Caroline Pham has expressed concerns that the CFTC's aggressive enforcement action might be infringing upon the SEC's authority, thus complicating the regulatory landscape for digital assets. Pham’s comments highlight the ongoing uncertainty and lack of clarity regarding which regulatory body has jurisdiction over various aspects of the crypto market, especially concerning the classification of cryptocurrencies as commodities or securities​.

Statement of Commissioner Caroline D. Pham Regarding KuCoin Complaint:

“The CFTC has filed another aggressive enforcement action exercising our authority to pursue alleged unregistered crypto asset derivatives trading platforms and other violations of law. I commend the Division of Enforcement’s vigilance in protecting our markets. However, I note that the complaint appears to assert that fund shares held by investors—namely, securities—can themselves constitute leveraged trading pursuant to section 2(c)(2)(D) of the Commodity Exchange Act. This interpretation fails to distinguish between an investment in a fund, which would typically be a security under the jurisdiction of the SEC, and the trading activities of a fund, alleged here to be under the CFTC’s jurisdiction. The CFTC’s approach may infringe upon the SEC’s authority and undermine decades of robust investor protection laws by conflating a financial instrument with a financial activity, disrupting the foundations of securities markets. Owning shares is not the same thing as trading derivatives.”

KuCoin's Response

KuCoin posted on social media site X reassuring that customer assets remain secure and that their legal team is actively investigating the allegations.  Kucoin also announced a compensation drop for withdrawal congestion and gratitude for loyalty users.

4 AML Challenges for 2024 and Beyond

Anti-money laundering is an issue plaguing more than just the financial industry. Due to our everyday lives becoming more digitized, it’s easier than ever to participate in financial means.

AML regulations exist to regulate and stop fraud, trafficking, tax evasion, and other illegal activities. Unfortunately, implementing regulations is hardly enough to prevent money laundering.

There are multiple challenges that pose obstacles for authorities and various institutions in finding a be-all and end-all solution.

Having said that, the current challenges shouldn’t be an entity that stops all the efforts to minimize money laundering.

Those struggling with the scheme should learn about the challenges and consider potential solutions that we’ll mention in this article.

1.  Lack of Sufficient Systems and Processes

Some organizations are simply too small to implement sufficient systems and processes to fend off money laundering threats.

It’s one thing to know about transaction monitoring rules and screening processes and another to actually have sufficient resources to create a functioning system.

Customer data, transactions, and third-party involvement create a complicated ecosystem. And it’s not just the missing tools. Despite advancements in automation, there still have to be competent officers and teams to keep everything in check.

How do we overcome this challenge? Institutions could look for ways to dedicate more resources, even if it means taking from another sector.

Adopting advanced analytical tools and hiring qualified personnel or investing in AML staffing and training programs are worth a shout, too.

2.  Insider Threats

Insider threats are another example of a challenge that disrupts an organization’s workflow. Current employees might take advantage of their position to benefit personally.

They avoid detection by using modern technology and collaborating with external criminal networks.

Privilege abuse lets internal threat abusers manipulate data and carry out sophisticated attacks that are hard to detect.

An insider malicious actor might slip up and get themselves caught. However, counting on that is anything but smart.

Taking a proactive approach is a more effective solution. Organizations ought to assess insider risks and implement analytical tools to monitor and identify suspicious behavior.

Significant penalties as a regulation do their job as well. If somebody knows about the potential consequences of laundering money within an institution, they are less likely to engage in such activities.

3.  Keeping Up With Changing Regulations

Considering the volume of money laundering worldwide and locally, the regulatory landscape suffers from constant evolution. At least in the sense that institutions struggle to keep up.

Modernizing and implementing more effective solutions by itself is a good thing, but from a company’s point of view, it’s tricky to stay up to date. Changes lead to compliance gaps and ensure confusion, which then means additional costs to an already expensive venture.

Since keeping up with changing regulations is imperative, the best way to go about it is by finding an AML solution that works as a single source for compliance. Regardless of the change, the solution remains up to date, as well as regulatory requirements.

4.  Modern Money Laundering Schemes

Criminals are usually ahead because they find new ways to launder money. Regulators have to react and detect these activities to prevent them. And when they do, the criminals probably have another new method or two up their sleeves, ready to move on and stay ahead.

It’s hard to imagine a scenario where regulators are in front and predict what the next money laundering scheme will look like. They dedicate resources to solve current problems instead.

Nevertheless, with enough resources, reducing the gap is not out of the question. At the very least, utilizing the latest technology to identify the latest money laundering methods to control them helps.
